Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement (together, the "Terms") govern your use of the Simplytrack mobile application and this website, published by Nikola Hamovic. Please read them carefully, since they include important limitations on our liability and an explicit statement that Simplytrack does not provide financial advice.

1. Acceptance of Terms

By downloading, installing, accessing, or using Simplytrack, you agree to be bound by these Terms. This agreement is between you and Simplytrack / Nikola Hamovic. It is not an agreement with Apple Inc. or Google LLC, although those companies may enforce certain provisions as described in Section 8.

If you do not agree to these Terms, do not download or use the app. If you are using Simplytrack on behalf of an organisation, you represent that you have authority to bind that organisation. You must be at least 13 years old to use the app, and you must have reached the age of majority in your jurisdiction to purchase a subscription.

2. License Grant & Restrictions

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use one copy of Simplytrack on devices that you own or control, solely for your own personal, non-commercial spending tracking.

You may not:

• Copy, modify, translate, or create derivative works of the app.
• Reverse engineer, decompile, or disassemble the app, or attempt to derive its source code, except to the extent this restriction is prohibited by applicable law.
• Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the app or your account.
• Remove, obscure, or alter any proprietary notices in the app.
• Use the app to build a competing product, or scrape or bulk-extract data from it.
• Circumvent, disable, or interfere with security features, subscription checks, or usage limits.
• Use the app in violation of any applicable law or regulation.

All rights not expressly granted to you are reserved by us. This is a license, not a sale, so you acquire no ownership interest in the app.

3. No Financial Advice Disclaimer

Calculations depend entirely on the accuracy and completeness of what you record. Simplytrack does not connect to financial institutions and cannot verify, reconcile, or correct your entries. Figures shown in the app may not match your bank statements and should not be relied upon for tax filings, loan applications, legal proceedings, or any other official purpose. You should consult a licensed professional before making significant financial decisions.

4. In-App Subscriptions & Billing

Free tier

Simplytrack is free to download and includes core expense and income tracking, categories, and basic summaries at no cost. No payment details are required to use the free tier.

Pro subscription

Simplytrack Pro is an optional paid subscription that unlocks advanced features such as extended analytics, spending goals, net worth tracking, and additional insights. Pro is offered on a monthly or annual basis. The annual plan is billed as a single up-front payment covering twelve months.

Current pricing, plan options, and any introductory or free-trial offer are displayed in the app and on the store listing at the time of purchase. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription before the trial ends. Prices may vary by country and are subject to change; changes will not affect a billing period you have already paid for.

Payment, renewal, and cancellation are handled by the app stores

Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your account is charged for renewal within 24 hours prior to the end of the current period, at the rate for your selected plan. Managing or cancelling a subscription is done entirely through your platform account settings. We cannot cancel, refund, or modify a store-managed subscription on your behalf.

How to cancel on iOS (Apple ID)

1. Open the Settings app on your iPhone or iPad.
2. Tap your name at the top, then tap Subscriptions.
3. Select Simplytrack.
4. Tap Cancel Subscription and confirm.

How to cancel on Android (Google Play)

1. Open the Google Play Store app.
2. Tap your profile icon, then Payments & subscriptions > Subscriptions.
3. Select Simplytrack.
4. Tap Cancel subscription and follow the prompts.

After cancelling you keep Pro access until the end of the period you have already paid for, after which the account reverts to the free tier. Your recorded data is not deleted when a subscription lapses, though features that require Pro become unavailable.

Refunds

Refund requests are determined by Apple or Google in accordance with their policies, not by us. To request a refund, contact the relevant store directly. Deleting the app does not cancel a subscription or entitle you to a refund.

5. User Conduct & Account Security

You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Choose a strong, unique password, do not share it, and keep your device secured with a passcode or biometric lock.

• Provide accurate account information and keep it current.
• Notify us promptly at contact@getsimplytrack.com if you suspect unauthorised access to your account.
• Do not attempt to access another user's account or data.
• Do not upload malicious code, probe or attack our infrastructure, or place unreasonable load on the service.
• Do not use the app for unlawful purposes, including money laundering, fraud, or tax evasion.

We are not liable for any loss arising from unauthorised use of your account where that use results from your failure to keep your credentials secure.

6. Your Content

The transactions, categories, notes, tags, and other records you enter remain yours. You grant us only the limited license necessary to host, store, back up, transmit, and display that content so we can operate the app for you, for example to sync your records between your devices and compute the summaries you see. We do not claim ownership of your content and we do not use it to train advertising models or sell it onward.

You are solely responsible for the accuracy and legality of what you record, and for keeping your own copies of anything you cannot afford to lose. Deleting your account permanently destroys your content, as described in our Privacy Policy.

7. Intellectual Property

All user interface designs, layouts, screens, icons, illustrations, animations, typography choices, copywriting, the Simplytrack name and logo, and all underlying source code are the exclusive property of Simplytrack / Nikola Hamovic and are protected by copyright, trade-mark, and other intellectual property laws.

Nothing in these Terms transfers any of those rights to you. You may not use the Simplytrack name, logo, or branding without our prior written permission, except to refer to the app factually. Feedback or suggestions you send us may be used without restriction and without obligation or compensation to you.

8. Third-Party Services

Simplytrack depends on third-party platforms including Google Firebase for authentication and data storage, and Apple App Store, Google Play Billing, and RevenueCat for subscription processing. Your use of those services is also governed by their own terms and privacy policies, and we are not responsible for their acts or omissions.

You acknowledge that Apple and Google are not parties to these Terms and have no obligation to provide maintenance or support for Simplytrack. To the extent permitted by law, Apple and Google bear no responsibility for the app, for any claim relating to it, or for any product warranty, whether express or implied. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you.

9. Warranty Disclaimer

Simplytrack is provided "AS IS" and "AS AVAILABLE", without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

We do not warrant that the app will be uninterrupted, timely, secure, or error-free; that defects will be corrected; that any calculation, insight, or projection will be accurate or complete; or that your data will never be lost or corrupted. You use the app at your own risk and are responsible for maintaining your own records.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits any non-waivable statutory consumer rights you may have.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Simplytrack, Nikola Hamovic, and any contributors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, goodwill, data, or business opportunity, arising out of or relating to your use of, or inability to use, the app, even if we have been advised of the possibility of such damages.

Without limiting the above, we are not liable for any financial loss, missed payment, overdraft, penalty, tax consequence, or investment outcome resulting from reliance on figures, insights, or summaries displayed in the app.

Our total aggregate liability for all claims relating to the app is limited to the greater of (a) the amount you paid us for Simplytrack in the twelve months preceding the event giving rise to the claim, or (b) CAD $50. These limitations apply regardless of the legal theory on which a claim is based and survive termination of these Terms.

11. Termination

You may stop using Simplytrack at any time and may delete your account from Settings > Account > Delete Account inside the app. We may suspend or terminate your access if you materially breach these Terms, if we are required to do so by law, or if we discontinue the service.

On termination, the license granted in Section 2 ends immediately and you must stop using the app. Sections covering intellectual property, disclaimers, limitation of liability, and governing law survive termination.

12. Changes to the Service & These Terms

We may add, change, or remove features, and we may update these Terms to reflect changes to the app, our providers, or the law. When we update the Terms we will revise the "Last Updated" date above, and for material changes we will provide additional notice such as an in-app message.

Continued use of Simplytrack after an update means you accept the revised Terms. If you do not accept them, stop using the app and delete your account.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-laws principles. You agree that the courts located in British Columbia, Canada have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the app, and you consent to their jurisdiction and venue.

If you are a consumer resident in a jurisdiction whose law grants you the right to bring proceedings locally or to rely on mandatory local consumer protections, nothing in this section removes that right.

14. General Provisions

• Entire agreement. These Terms, together with our Privacy Policy, form the entire agreement between you and us regarding Simplytrack and supersede any prior understandings.
• Severability. If any provision is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full force.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
• Headings. Section headings are for convenience only and do not affect interpretation.
